Defense nominee Hagel plans to shed some holdings

WASHINGTON (AP) ? Secretary of Defense nominee Chuck Hagel has told Pentagon officials he plans to divest some of his financial holdings and resign from several corporate boards and public interest groups to avoid potential conflicts of interest if he wins Senate confirmation.

Hagel told Defense Department officials in a letter last week that he would resign his corporate board post at Chevron Corp. and shed investments in the energy firm, a major government contractor. He would also cut ties and investments with the McCarthy Group LLC, an Omaha-based private equity firm.

A new personal financial disclosure filed with the Office of Government Ethics lists Hagel's assets at between $2.8 million and $6 million, according to an Associated Press analysis. Hagel made earnings of more than $1 million last year, including director's fees at Deutsche Bank, Zurich Insurance Group and Corsair Capital. Hagel said he would also server ties to those firms.

Hagel's Pentagon nomination has run into heavy fire from conservatives and Republicans who question whether he is sufficiently supportive of Israel. They also question his support for reductions in the nuclear arsenal. Some of his wide-ranging corporate and activist roles have also drawn criticism that his decision-making could be swayed by prior relationships. Hagel's letter to defense officials indicates he is willing to sell off possible conflict holdings and end his directorships to mute those concerns, but would still retain the ability to make his own investments.

In a letter sent last week to Robert Taylor, the Pentagon's acting general counsel, Hagel said that if he wins the defense post, he and his wife would not "invest in any company identified as a Department of Defense contractor or any other entity that would create a conflict of interest with my government duties." Hagel also pledged that if any firm that he has holdings in wins a defense contract, he would sell off those investments.

Some nominees for top government positions place their holdings in federally approved blind trusts so that they have no direct role in private investments during their tenure. There is no mention of the use of a blind trust in Hagel's letter.

Sen. John Kerry, President Barack Obama's pick for secretary of state, has holdings worth more than $184 million, and is also not using a blind trust. Most of Kerry's investments are made through family trusts, which limit his direct involvement but are not as segregated as blind trusts qualified by the Office of Government Ethics.

In his letter, Hagel said he would not participate in any decision that "has a direct and predictable effect on my financial interests" and would request a waiver from the ethics office if he planned any move that could affect him financially.

Hagel's decision to sever his dealings and investments with Chevron were clearly dictated by the firm's extensive dealings with the Pentagon. According to government figures, Chevron received more than $500 million in defense contracts in 2012, ranking 78th among the department's largest corporate beneficiaries.

Hagel joined Chevron's board of directors in 2010 and made $116,000 in fees in 2012. He also has Chevron common stock worth between $100,000 and $250,000 according to his disclosure.

Activists from both the left and right have questioned Chevron's recent involvement with repressive governments, including its plans to develop natural gas reserves in Turkmenistan and its pipeline work in Burma.

One conservative non-profit interest group, the American Future Fund, took aim at Hagel's relationship with Chevron, asking in an attack ad: "How can Chuck Hagel run the Pentagon with so many ethical questions about his own record?"

That broadside came before Hagel's letter outlining his divestment plans. The Senate Armed Services Committee also has some of the most stringent rules for nominees for senior civilian positions in the Defense Department. And Hagel's plans for divesting his holdings were also expected to undergo careful vetting by lawyers and ethics experts at the OGE, Defense and the White House.

After many months and a few false starts, the long-awaited client prepares for initial release

It's tough to talk about the Carbon for Android Twitter client without saying a few things up front:

  1. No, it's still not available. But that we've been given a pre-release version to share should tell you something.
  2. Yes, we're all very much aware that we've been talking about Carbon, off and on, for more than a year now. (A whopping six stories out of some 6,000 written over 13 months, if our math is right.) Announcements of imminent release have come and gone, followed by long periods of silence. You can either choose to get over that, read this preview and give this app a shot when it's released in the near future, or not. 
  3. There are now two Carbon apps for Android. This one, obviously, is the Twitter app, from the developer dots & lines, which first brought Carbon to webOS, where it garnered much praise. It later came to Windows Phone before being put out to pasture, much to the chagrin of this Microsoft faithful. The other Carbon app is a backup and sync client from Koushik Dutta. We're not sure which app will see first public release (our money's on the backup app), but having two apps with the same name is about as fun for us as it is for you, we reckon.
  4. Carbon (the Twitter app) may well be the best-designed Twitter app we've used yet -- and there are some good ones out there.

(AP) ? The legal challenges over religious freedom and the birth control coverage requirement in President Barack Obama's health care overhaul appear to be moving toward the U.S. Supreme Court.

Faith-affiliated charities, hospitals and universities have filed dozens of lawsuits against the mandate, which requires employers to provide insurance that covers contraception for free. However, many for-profit business owners are also suing, claiming a violation of their religious beliefs.

The religious lawsuits have largely stalled, as the Department of Health and Human Services tries to develop an accommodation for faith groups. However, no such offer will be made to individual business owners. And their lawsuits are yielding conflicting rulings in appeals courts around the country.

"The circuits have split. You're getting different, conflicting interpretations of law, so the line of cases will have to go to the Supreme Court, " said Carl Esbeck, a professor at the University of Missouri Law School who specializes in religious liberty issues.

Last year, the Supreme Court ruled that Obama's fiercely contested health care overhaul, known as the Affordable Care Act, was constitutional. But differences over the birth control provision in the law have yet to be resolved.

Under the requirement, most employers, including faith-affiliated hospitals and nonprofits, have to provide health insurance that includes artificial contraception, including sterilization, as a free preventive service. The goal, in part, is to help women space pregnancies as a way to promote health.

Religious groups who employ and serve people of their own faith ? such as churches ? are exempt. But other religiously affiliated groups, such as Catholic Charities, must comply.

Roman Catholic bishops, evangelicals and some religious leaders who have generally been supportive of Obama's policies have lobbied fiercely for a broader exemption. The Catholic Church prohibits the use of artificial contraception. Evangelicals generally permit the use of birth control, but they object to specific methods such as the morning-after contraceptive pill, which they argue is tantamount to abortion.

Obama promised to change the birth control requirement so insurance companies and not faith-affiliated employers would pay for the coverage, but religious leaders said more changes were needed to make the plan work.

The Health and Human Services Department said it could not comment on litigation. A spokeswoman also did not respond to a question about when the latest revisions in the birth control rule would be made public.

However, government attorneys responding to a lawsuit said an announcement was expected by the end of March. In the suit filed by the evangelical Wheaton College in Illinois and Catholic Belmont Abbey in North Carolina, the court ordered government attorneys to provide a progress report on the new rule every 60 days. Whatever its final form, the mandate will take effect for religious groups in August.

At the center of the cases is the Religious Freedom Restoration Act, the 1993 law that bars the government from imposing a substantial burden on the exercise of religion for anything other than a compelling government interest pursued in the least restrictive way. The question of how or whether these criteria apply when owners of for-profit businesses have a religious objection to a government policy hasn't been fully tested.

"It's more natural for people to say Notre Dame exercises religion, but when you say this power tool company exercises religion, you have to explain it little more, I think the claims are really the same," said Kyle Duncan, general counsel for the Becket Fund for Religious Liberty, which represents many of the plaintiffs.

Brigitte Amiri, senior staff attorney at the American Civil Liberties Union, argued the business owners are trying to use a religious liberty claim to deny benefits to someone else.

"We don't think that religious liberty claims can be used as a way to discriminate against women employees ? using those claims to take away someone else's benefits and services," Amiri said.

In the lawsuits from faith-affiliated groups, such as the University of Notre Dame, judges around the country have generally said it would be premature to decide the legal issues until the federal rule for religiously affiliated organizations is finalized.

In the cases involving business owners, judges have granted temporary injunctions to businesses in nine of 14 cases they've heard, while questions about for-profit employers and religious rights are decided, according to a tally by the Becket Fund.

In a case brought by Cyril and Jane Korte, Catholic owners of Korte & Luitjohan Contractors in Illinois, a three-judge panel granted a temporary injunction, ruling 2-1 that providing employees insurance coverage that includes birth control would violate the Kortes' faith.

"It is a family-run business, and they manage the company in accordance with their religious beliefs," the judges wrote.

The dissenting judge argued that the company will not be paying directly for contraception but instead will purchase insurance that covers a wide range of health care that could include birth control, if the woman decides with her physician that she needs it.

"What the Kortes wish to do is to preemptively declare that their company need not pay for insurance which covers particular types of medical care to which they object," the dissenting judge wrote.

Similar reasoning was used by courts denying an injunction requested by the arts and crafts chain Hobby Lobby and religious book-seller Mardel Inc., which are owned by the same evangelical family. Oklahoma-based Hobby Lobby calls itself a "biblically founded business" and is closed on Sundays.

The U.S. district judge who first considered the request said, "Hobby Lobby and Mardel are not religious organizations."

"Plaintiffs have not cited, and the court has not found, any case concluding that secular, for-profit corporations such as Hobby Lobby and Mardel have a constitutional right to the free exercise of religion," the ruling said.

'Dallas' returns with J.R. Ewing's final schemes

(AP) ? J.R. Ewing wouldn't hesitate to cheat his fellow man. He also famously cheated death.

In the second-season finale of "Dallas" back in 1980, he was shot by an unknown assailant in his office and left for dead. But he recovered nicely, and the cliffhanger question that gripped the nation (Who shot J.R.?) was answered that November in an episode seen by 80 million viewers.

This time, J.R. won't get off so easy. During the second season of TNT's rebooted "Dallas," J.R. cashes in his chips and goes to his reward ... wherever that may be.

Meanwhile, viewers, however braced they are for J.R.'s demise, will have to reckon with the loss of arguably TV's greatest villain, and bid farewell to the actor who portrayed him so indelibly and also cheated death for years. This double loss would be a burden for any show to bear. "Dallas," returning at 9 p.m. EST Monday, comes fully loaded.

"I think viewers want closure," said Linda Gray, who plays J.R.'s long-suffering ex-wife, Sue Ellen. "They want to mourn Larry Hagman and J.R. Ewing. They want to know they can grieve the fact he won't be around."

But all that comes later. With its two-hour season premiere, "Dallas" carries on in familiar fashion, with the expected two-timing, squabbles, a kidnapping revealed, a stolen identity and assorted other mischief.

And never fear: J.R., though visibly frail, continues his reign as a scheming oilman and rascally Ewing patriarch.

"I came over to deliver some muffins to the pretty little secretaries," he announces on making an unannounced visit to Ewing Energies headquarters before he laments, "Who could have guessed so many would turn out to be MEN? Where's the sport in THAT?"

In another scene, J.R. shares sly counsel with his son, John Ross, on double-crossing other members of the family: "Love, hate, jealousy: Mix 'em up and they make a mean martini. And when we take over Ewing Energies, you'll slake your thirst ? with a twist!"

The new "Dallas," which debuted last June, is stocked with a troupe of young regulars (including Josh Henderson, who plays John Ross), as well as veterans of the original CBS series, notably Gray and Patrick Duffy as J.R.'s ever-upright brother, Bobby. J.R. will appear in a minimum of five or as many as seven of the season's episodes before he meets his fate.

After that, can "Dallas" survive the dual deaths of its central character and legendary star?

"Larry being gone doesn't eliminate the influence of the character of J.R.," Duffy pointed out. Who knows what land mines J.R. will have left behind? "We can find business deals he did or schemes he started that now are coming home to roost, and they can turn up for years to come."

"Whatever will happen on the show, we will be talking about J.R. Ewing and he will have done things that have a ripple effect," Gray agreed. "He will always be there."

"There's a lot of driving forces on the show ? not just J.R.," added "Dallas" executive producer Cynthia Cidre, who, interviewed by phone a couple of weeks ago, was parked outside a posh Dallas social club where the wake for J.R. was about to be filmed.

She said this season she tried to use Hagman sparingly.

"He was the most delightful man and a total professional," she said, "but he wasn't well and we didn't want to overtax him."

Now, with his passing, "we want to give J.R., and Larry, the proper send-off."

But she insisted there had been no contingency plan for how to plot J.R.'s demise in the event Hagman died in mid-season.

"We didn't have a Plan B, on purpose," said Cidre. "We just knew that we had Larry, so let's use him, let's enjoy him, and if something happens, we'll scramble and fix it. I had great faith in the writers' room. We knew the day might come and what we would do then: Figure it out."

That day came in late November when she got a call from Duffy. "He told me, 'Larry's in the hospital and it isn't good. He's saying goodbye.' In 24 hours we had fixed one of the scripts. We had two more scripts that had to be adjusted, and then this episode we're shooting now, the Goodbye Episode."

Roughly 85 percent of the season's story line remains intact, she said, supplemented by the death of J.R. and the mystery surrounding it: Who Killed J.R.?

"The mystery has all the machinations of a great J.R. business deal, as opposed to a whodunit," said Duffy. "Cynthia constructed a really interesting plot, of which I know Bobby's portion" ? including whodunit ? "but I don't know other stuff."

"We all know, up to a point," Gray said. "But they've got secret pages that we've not seen."

"I hope that we have come up with something really wonderful and enticing," said Cidre, "and by the time you're done watching episode 208, which I call the Funeral Episode, I hope you're saying, 'Omigod, I didn't see that coming, and I can't wait to watch the rest of the season.'"

The mystery, she said, will continue through episode 15, "with a giant, delightful, delicious climax in the season finale."

To get there, shooting continues until April on the Dallas set, where, even two months after Hagman's passing, "I'm lonely because my best friend isn't there to play with," Duffy said. "I was with him from 1978 until his final hours in the hospital. But I have no regrets. Every day I think of him and smile."

"I keep expecting him to walk in the door," Gray said. "He's so missed. But his presence is everywhere!"

S&P 500 closes above 1,500 for 1st time in 5 years

The S&P 500 index on Friday closed above the 1,500 level for the first time in more than five years as strong U.S. earnings reports from Procter & Gamble and others helped the benchmark extend its rally to eight days.?

The Dow Jones industrial average was up 70.50 points, or 0.51 percent, at 13,895.83. The Standard & Poor's 500 Index was up 8.11 points, or 0.54 percent, at 1,502.93. The Nasdaq Composite Index was up 19.33 points, or 0.62 percent, at 3,149.71.?

For the week, the Dow rose 1.8 percent, the S&P climbed 1.1 percent and the Nasdaq rose 0.5 percent. It was the fourth straight week of gains for all three indexes.?

Data showed sales of new U.S. single-family homes fell in December but rose in 2012 to the highest level since 2009, a sign the troubled U.S. housing market has turned a corner.?

"Economic data in the U.S. has been trending higher, albeit modestly. Things are incrementally better," said Quincy Krosby, market strategist at Prudential Financial in Newark, New Jersey.?

"The market was able to move forward despite deterioration in Apple and that's also a positive."?

Apple shares dropped 1.2 percent to $444.99, and the iPhone maker was swapping places as the most valuable U.S. company with ExxonMobil Corp through the afternoon.?

Adding to the bullish tone, German business morale improved for a third consecutive month in January to its highest in more than six months. In addition, European banks said they will repay the European Central Bank much more than expected of the loans the bank gave them during the crisis.?

"Good news in credit markets helps set the stage for (more investment in) riskier assets," Krosby said.?

Procter & Gamble shares rose 3.6 percent to $72.99 after the world's top household products maker's quarterly profit soared past expectations. The company also raised its sales and earnings outlook for the fiscal year.?

The benchmark S&P 500 index is up more than 5 percent so far in January. The equity market's strong start this year has been attributed to solid corporate results, an agreement in Washington to extend the government's borrowing power, encouraging signs from the global economy and seasonal inflows into stocks.?

Helping to lift the Nasdaq Composite, Starbucks , rose 4.5 percent to $57.01 after the coffee retailer reported stronger-than-expected sales in the United States and Asia.?

Thomson Reuters data through Friday showed that of the 147 S&P 500 companies that have reported earnings, 68 percent exceeded expectations. Since 1994, 62 percent of companies have topped expectations, while the average over the past four quarters stands at 65 percent.?

Halliburton Co shares jumped 5 percent to $39.69 after the world's second-largest oilfield services company reported higher-than-expected earnings and sales for the fourth quarter.?

Court says Obama appointments violate constitution

(AP) ? President Barack Obama violated the Constitution when he bypassed the Senate last year to appoint three members of the National Labor Relations Board, a federal appeals court ruled Friday in a far-reaching decision that could severely limit a chief executive's powers to make recess appointments.

The court's decision marked a victory for Republicans and business groups critical of the agency. If it stands, it could invalidate hundreds of board decisions over the past year, including some that make it easier for unions to organize.

The three-judge panel of the U.S. Court of Appeals for the D.C. Circuit said that contrary to the administration's claim, the Senate was not in recess at the time Obama filled the vacancies on Jan. 4, 2012.

It also held that presidents have the authority to bypass the Senate in filling vacancies only when they occur during a recess, which it said occurs only between the end of the first year of a two-year Congress and when lawmakers convene for the second year.

White House press secretary Jay Carney said the administration strongly disagrees with the decision and that the NLRB would continue to conduct business as usual, despite calls by some Republicans for the board members to resign.

"The decision is novel and unprecedented," Carney said. "It contradicts 150 years of practice by Democratic and Republican administrations."

Under the court's decision, 285 recess appointments made by presidents between 1867 and 2004 would be invalid.

The Justice Department hinted that the administration would ask the Supreme Court to overturn the decision, which was rendered by three conservative judges appointed by Republican presidents. "We disagree with the court's ruling and believe that the president's recess appointments are constitutionally sound," the statement said.

The court acknowledged that the ruling conflicts with what some other federal appeals courts have held about when recess appointments are valid, which only added to the likelihood of an appeal to the high court.

The ruling also threw into question the legitimacy of Obama's recess appointment of Richard Cordray to head the Consumer Financial Protection Bureau. Cordray's appointment, made on the same date, has been challenged in a separate case.

Carney insisted the court's ruling affects only a single case before the labor board and would have no bearing on Cordray's appointment. Obama on Thursday renominated Cordray for the job.

Obama made the recess appointments after Senate Republicans blocked his choices for an agency they contended was biased in favor of unions. Obama claims he acted properly because the Senate was away for the holidays on a 20-day recess. The Constitution allows for such appointments without Senate approval when Congress is in recess.

But during that time, GOP lawmakers argued, the Senate technically had stayed in session because it was gaveled in and out every few days for so-called pro forma sessions.

GOP lawmakers used the tactic ? as Democrats had done in the past ? specifically to prevent the president from using his recess power to install members to the labor board and the consumer board. They had also vigorously opposed the nomination of Cordray. The White House argued that the pro forma sessions ? some lasting less than a minute ? were a sham.

The three-judge panel flatly rejected arguments from the Justice Department's Office of Legal Counsel, which claimed that the president has discretion to decide that the Senate is unavailable to perform its advice and consent function.

"Allowing the president to define the scope of his own appointment power would eviscerate the Constitution's separation of powers," Chief Judge David Sentelle wrote in the 46-page ruling. He was appointed by President Ronald Reagan.

The court ruled that during one of those pro forma sessions on Jan. 3, 2012, the Senate officially convened its second session of the 112th Congress, as required by the Constitution.

Sentelle's opinion was joined by Judge Thomas Griffith, appointed to the court by President George W. Bush, and Karen LeCraft Henderson, who was appointed by President George H.W. Bush.

"With this ruling, the D.C. Circuit has soundly rejected the Obama administration's flimsy interpretation of the law, and (it) will go a long way toward restoring the constitutional separation of powers," said Sen. Orrin Hatch, R-Utah.

GOP House Speaker John Boehner welcomed the ruling as "a victory for accountability in government."

If the ruling stands, it would invalidate more than 600 board decisions issued over the past year. It also would leave the five-member labor board with just one validly appointed member, effectively shutting it down. The board is allowed to issue decisions only when it has at least three sitting members.

Obama used the recess appointment to install Deputy Labor Secretary Sharon Block, union lawyer Richard Griffin and NLRB counsel Terence Flynn to fill vacancies on the labor board, giving it a full contingent for the first time in more than a year. Block and Griffin are Democrats, while Flynn is a Republican. Flynn stepped down from the board last year.

All three vacancies on the labor board had been open for months before Obama acted to fill them.

"I think this is a very important decision about the separation of powers," said Carl Tobias, a constitutional law professor at Virginia's University of Richmond. "The court's reading has limited the president's ability to counter the obstruction of appointments by a minority in the Senate that has been pretty egregious in the Obama administration."

"Today's circuit court decision is not only a radical departure from precedent, it ignores the fact that President Obama had no choice but to act," said Sen. Tom Harkin, D-Iowa. "Throughout his presidency, Republicans have employed unprecedented partisan delay tactics and filibusters to prevent confirmation of nominees to lead the NLRB, thus crippling the board's legal authority to act."

If Obama's recess appointment of Cordray to the newly created consumer board is eventually ruled invalid, it could nullify all the regulations the consumer board has issued, many of which affect the mortgage business.

(AP) ? Breaking new ground, the U.S. Education Department is telling schools they must include students with disabilities in sports programs or provide equal alternative options. The directive, reminiscent of the Title IX expansion of athletic opportunities for women, could bring sweeping changes to school budgets and locker rooms for years to come.

Schools would be required to make "reasonable modifications" for students with disabilities or create parallel athletic programs that have comparable standing as mainstream programs.

"Sports can provide invaluable lessons in discipline, selflessness, passion and courage, and this guidance will help schools ensure that students with disabilities have an equal opportunity to benefit from the life lessons they can learn on the playing field or on the court," Education Secretary Arne Duncan said in a statement announcing the new guidance on Friday.

Federal laws, including the 1973 Rehabilitation Act and the Individuals with Disabilities Education Act, require states to provide a free public education to all students and bans schools that receive federal funds from discriminating against students with disabilities. Going further, the new directive from the Education Department's civil rights division explicitly tells schools and colleges that access to interscholastic, intramural and intercollegiate athletics is a right.

"This is a landmark moment for students with disabilities. This will do for students with disabilities what Title IX did for women," said Terri Lakowski, who led a coalition pushing for the changes for a decade. "This is a huge victory."

Education Department officials emphasized they did not intend to change sports' traditions dramatically or guarantee students with disabilities a spot on competitive teams. Instead, they insisted schools cannot exclude students based on their disabilities if they can keep up with their classmates.

"It's not about changing the nature of the game or the athletic activity," said Seth Galanter, the acting assistant secretary for civil rights at the Education Department.

It's not clear whether the new guidelines will spark a sudden uptick in sports participation. There was a big increase in female participation in sports after Title IX guidance instructed schools to treat female athletics on par with male teams. That led many schools to cut some men's teams, arguing that it was necessary to be able to pay for women's teams.

There is no deadline for schools to comply with the new disabilities directive.

But activists cheered the changes.

"This is historic," said Bev Vaughn, the executive director of the American Association of Adapted Sports Programs, a nonprofit group that works with schools to set up sports programs for students with disabilities. "It's going to open up a whole new door of opportunity to our nation's school children with disabilities."

A Government Accountability Office study in 2010 found that students with disabilities participated in athletics at consistently lower rates than those without. The study also suggested the benefits of exercise among children with disabilities may be even important because they are at greater risk of being sedentary.

"We know that participation in extracurricular activities can lead to a host of really good, positive outcomes both inside and outside of the classroom," said Kareem Dale, a White House official who guides the administration's policies for disabled Americans.

Dale, who is blind, wrestled as a high school student in Chicago alongside students who had full vision.

"I was able to wrestle mainly because there was a good accommodation to allow me to have equal access and opportunity," Dale said, describing modified rules that required his competitors to keep in physical contact with him during matches.

Those types of accommodations could be a model for schools and colleges now looking to incorporate students with disabilities onto sports teams. For instance, track and field officials could use a visual cue for a deaf runner to begin a race.

Some states already offer such programs. Maryland, for instance, passed a law in 2008 that required schools to create equal opportunities for students with disabilities to participate in physical education programs and play on mainstream athletic teams. And Minnesota awards state titles for disabled student athletes in six sports.

Increasingly, those with disabilities are finding spots on their schools' teams.

Current rules require Followay to race on his own, without competitors running alongside him. He said he hopes the Education Department guidance will change that and he can compete against runners.

"It's going to give me the chance to compete against kids at my level," he said.

In cases where students with disabilities need more serious changes, a separate league could be required.

Although the letter is directed to elementary and secondary schools and the department hasn't provided comparable guidance to colleges, some of the principles in the letter will be read closely by administrators in higher education, said Scott Lissner, the Americans with Disabilities coordinator at Ohio State University and president of the Association on Higher Education and Disability.

"The logic that's in there applies us to us as well as it does to K-12, for the most part," Lissner said.

While slightly different portions of civil rights law apply to colleges and universities, "their approach in this letter was really more about the basic underlying equity and civil rights issues" that colleges also must ensure they're applying to pass muster under the law.

Generally, Lissner said, as colleges review their policies, the effects would more likely be felt in intramural and club sports programs on campus than intercollegiate ones, Lissner said. That's because relatively few people can meet the standards to compete in intercollegiate sports, and nothing in the guidance requires a change in such standards. But the purpose of intramural and club sports is broader, and colleges may have to do more to ensure students with disabilities aren't deprived of a chance to compete.

Some cautioned that the first few years would bring fits and starts.

"Is it easy? No," said Brad Hedrick, director of disability services at the University of Illinois at Urbana-Champaign and himself a hall-of-famer in the National Wheelchair Basketball Association. "In most places, you're beginning from an inertial moment. But it is feasible and possible that a meaningful and viable programming can be created."

Establishing students' needs would be the first step, followed by training for educators and coaches.

"We need to determine how many children would qualify and then look to where kids can be integrated onto traditional teams appropriately. Where we can't, then we need to add an adaptive program," said Vaughn, who has advised states and districts how to be more inclusive.

"Typically, the larger school districts realistically could field a varsity and junior varsity team in each sport. In more rural areas, we would do a regional team. It's not going to overwhelm our schools or districts. It's just going to take some solid planning and commitment."

Two Sources of Cash to Grow Your Retail Business | FundWell

Often people seeking to open a small retail business, such as a clothing store, in a lower-income community face challenges.

Low-income individuals often have a more difficult time obtaining financing for their small businesses. Low-income communities tend to lack infrastructure that small businesses need to grow, such as safe business corridors that enjoy foot traffic. Because it is often hardest to start and maintain small businesses, such as retail stores, in the areas in which they are most needed, federal, state, and local governments have developed programs to assist small business owners gain access to capital and to attract small businesses to lower-income areas. There are many different kinds of incentive programs across the country. Below is a general overview of two different types of financial assistance that may be available to your small retail business.

Assistance Gaining Access to Capital (CDFIs)

Understanding that small businesses seeking financing in traditionally underserved communities faced significant financing barriers, the federal government created the Community Development Financial Institutions (?CDFI?) Fund in 1994. Administered by the U.S. Department of the Treasury, the CDFI Fund does not itself loan money to individuals, rather it provides financing, including capital and tax credits, to CDFIs?banks, credit unions, venture capital funds, and nonprofit community lenders?which in turn lend money to individuals which meet the CDFI?s criteria. Not every bank is a CDFI. In order to be designated a CDFI, an institution must submit a CDFI Certification Application to the Fund for review and approval. To be eligible for certification, the institution must be located in an underserved or under-developed part of the country, and ?Have a primary mission of promoting community development.? There are more than 1,000 CDFIs operating in the United States.

CDFI?s provide financing to people in low-income urban and rural areas who would otherwise have a difficult time obtaining capital at competitive rates. CDFI?s provide more than financing, however. CDFI?s provide financial education and counseling services to their customers as well. Each CDFI sets its own programs and criteria for financing eligibility, so to determine if CDFI funds might be available for your small retail business, you need to contact individual CDFIs. The CDFI Fund maintains a searchable database of CDFIs at http://www.cdfifund.gov/awardees/db/index.asp. Tax Increment Financing (TIFs)?

Tax Increment Financing or ?TIF? is a tax revenue tool used by state and local governments to spur economic development in blighted areas. TIF uses anticipated future gains in property tax revenue (the ?tax increment?) to subsidize the current development and improvements necessary to bring about the higher property values that will generate those future gains in property tax revenue. For example, in order for a city to attract a developer to a blighted area, the city may help finance some or all of the developer?s eligible project costs (such as sidewalk improvements, environmental remediation, site grading), using capital it borrows against the future increases in the property-tax revenue that will result by virtue of the development.

Jurisdictions establish their own TIF programs and establish criteria to determine what geographic areas and projects are eligible for those programs. Some of these programs could be especially helpful to a small retail business. In Chicago, for example, the Department of Housing and Economic Development?s Tax Increment Financing program developed TIFWorks. TIFWorks is a workforce development initiative that funds workforce-training costs for businesses located in TIF districts. Types of eligible training include technology skills, management, and sales. Other jurisdictions have created their own programs, so be sure to investigate what options are available in your area.

What Capitalism Can't Fix - Phil Buchanan - Harvard Business Review

Increasingly, I see people looking starry-eyed to business and markets to solve social problems. In so doing, they run the risk of dismissing the impact of nonprofits ? and diminishing the value of organizations that seek to make a difference without creating the potential conflicts that come with the profit motive. My view is that pretending companies and markets hold all the answers actually puts at risk our ability to deal with our most pressing societal problems ? and to help our most vulnerable citizens.

The rhetoric is everywhere ? from the trade press to the mainstream media to business school faculty to corporate titans to Silicon Valley entrepreneurs. Former GE CEO Jack Welch, writing in Business Week, characterized the nonprofit sector as a "foreign land" in which performance is not a priority and employees are guaranteed "lifetime employment." Alexis Ohanian, co-founder of Reddit, wrote last year on the Wired web site, "Let's be real: The nonprofit model is broken. The 20th-century way of "guilting" people into giving to an opaque, inefficient organization with massive overhead is no longer a viable model." In a recent blog post here on HBR.org, Dan Pallotta suggests that nonprofits should use the tools of capitalism such as high pay and providing returns to investors to increase charitable giving.

The rush to disparage nonprofits and the stampede to embrace the idea that for-profits ? or for-profit models ? can more easily combat our toughest social problems deny reality. Many crucial objectives simply cannot be accomplished while generating a financial return. Other objectives can but there is a price to be paid. In health care, for example, research indicates a decline in quality when non-profit hospitals switched to become profit making, as Eduardo Porter explained this month in the New York Times.

The laudable push for companies to commit more energy to dealing with social problems should not obscure the need for strong independent nonprofits that focus on mission not profit. And while nonprofits can learn from companies and companies can learn from nonprofits, it is a mistake to deny differences.

After all, there is a crucial distinction between an institution that reinvests surpluses in its mission and one that faces unrelenting pressure to distribute profit to shareholders. Consider higher education in the United States. Nonprofit universities frequently offer an education that costs more than actual tuition ? the difference made up through charitable gifts and endowment returns ? while for-profit institutions must cover their costs with tuition and create a profit margin. The results ? and the evidence from lawsuits, media reports, and congressional and GAO investigations of for-profit universities ? speak for themselves.

Despite this and many other cautionary tales, an increasing number of people both inside and outside the nonprofit world seem drunk on the Kool-Aid of business superiority. Too often people equate "business thinking" with effectiveness. Even those inside the world of nonprofits and philanthropy have internalized the idea that operating "like a business" means operating effectively (never asking which business: Countrywide Financial? BP? Enron?).

The stereotypes of nonprofits are just that: stereotypes. There are, of course, numerous examples of nonprofit influence and impact ? from work on environmental issues to citizens' rights to reductions in tobacco use to reductions in worldwide child mortality ? but also lesser known examples. Take the work of the Institute for Healthcare Improvement, a nonprofit whose 18-month campaign to reduce hospital mortality rates has saved an estimated 122,300 lives by inspiring and guiding hospital executives, physicians, and nurses to adopt six basic patient-safety practices. As Peter Fader, a University of Pennsylvania professor and director of the Wharton Customer Analytics Initiative, has observed: Nonprofits often excel at using "their data to better understand their 'customer base.' In this area, big companies with lots of resources really can learn from their cash-strapped nonprofit cousins."

The point is this: No type of organization ? government, business, or nonprofit ? has a monopoly on effectiveness. And nonprofits are typically tackling the most complex problems of all. If those problems could have easily been solved by government or business, they wouldn't exist at all.

I'm a huge believer in free-market capitalism. I have an M.B.A. and have worked as a corporate consultant. But I think we're better off being sober about what markets can and cannot accomplish.

I'd suggest three practical questions to ask in sorting through how to achieve important social goals.

  • Does the pursuit of profit conflict with or facilitate the achievement of your goal? How likely are profit and social impact to be in tension? How will that tension be managed or resolved?
  • What kind of choices and information do people have? Markets work best when people have choices and when there is good information, so ask, do those conditions apply? Are you looking at an opportunity ? like creating products or technologies that will help poor people in some aspect of their lives ? that lends itself to a free-market solution? Or are you looking at something, like the management of a prison or nursing home system for a state, where a provider is likely to have a virtual monopoly ? meaning management is free to prioritize profit over the social mission without paying any kind of price?
  • Finally, are you addressing an issue that actually results from market failure, such as, environmental degradation? If you don't understand capitalism's role in contributing to a problem, you probably won't be able to rely on capitalism to chart a path to the solution.

Then decide what makes most sense, and don't assume that a pure nonprofit isn't the way to go.
