Defense nominee Hagel plans to shed some holdings

WASHINGTON (AP) ? Secretary of Defense nominee Chuck Hagel has told Pentagon officials he plans to divest some of his financial holdings and resign from several corporate boards and public interest groups to avoid potential conflicts of interest if he wins Senate confirmation.

Hagel told Defense Department officials in a letter last week that he would resign his corporate board post at Chevron Corp. and shed investments in the energy firm, a major government contractor. He would also cut ties and investments with the McCarthy Group LLC, an Omaha-based private equity firm.

A new personal financial disclosure filed with the Office of Government Ethics lists Hagel's assets at between $2.8 million and $6 million, according to an Associated Press analysis. Hagel made earnings of more than $1 million last year, including director's fees at Deutsche Bank, Zurich Insurance Group and Corsair Capital. Hagel said he would also server ties to those firms.

Hagel's Pentagon nomination has run into heavy fire from conservatives and Republicans who question whether he is sufficiently supportive of Israel. They also question his support for reductions in the nuclear arsenal. Some of his wide-ranging corporate and activist roles have also drawn criticism that his decision-making could be swayed by prior relationships. Hagel's letter to defense officials indicates he is willing to sell off possible conflict holdings and end his directorships to mute those concerns, but would still retain the ability to make his own investments.

In a letter sent last week to Robert Taylor, the Pentagon's acting general counsel, Hagel said that if he wins the defense post, he and his wife would not "invest in any company identified as a Department of Defense contractor or any other entity that would create a conflict of interest with my government duties." Hagel also pledged that if any firm that he has holdings in wins a defense contract, he would sell off those investments.

Some nominees for top government positions place their holdings in federally approved blind trusts so that they have no direct role in private investments during their tenure. There is no mention of the use of a blind trust in Hagel's letter.

Sen. John Kerry, President Barack Obama's pick for secretary of state, has holdings worth more than $184 million, and is also not using a blind trust. Most of Kerry's investments are made through family trusts, which limit his direct involvement but are not as segregated as blind trusts qualified by the Office of Government Ethics.

In his letter, Hagel said he would not participate in any decision that "has a direct and predictable effect on my financial interests" and would request a waiver from the ethics office if he planned any move that could affect him financially.

Hagel's decision to sever his dealings and investments with Chevron were clearly dictated by the firm's extensive dealings with the Pentagon. According to government figures, Chevron received more than $500 million in defense contracts in 2012, ranking 78th among the department's largest corporate beneficiaries.

Hagel joined Chevron's board of directors in 2010 and made $116,000 in fees in 2012. He also has Chevron common stock worth between $100,000 and $250,000 according to his disclosure.

Activists from both the left and right have questioned Chevron's recent involvement with repressive governments, including its plans to develop natural gas reserves in Turkmenistan and its pipeline work in Burma.

One conservative non-profit interest group, the American Future Fund, took aim at Hagel's relationship with Chevron, asking in an attack ad: "How can Chuck Hagel run the Pentagon with so many ethical questions about his own record?"

That broadside came before Hagel's letter outlining his divestment plans. The Senate Armed Services Committee also has some of the most stringent rules for nominees for senior civilian positions in the Defense Department. And Hagel's plans for divesting his holdings were also expected to undergo careful vetting by lawyers and ethics experts at the OGE, Defense and the White House.

After many months and a few false starts, the long-awaited client prepares for initial release

It's tough to talk about the Carbon for Android Twitter client without saying a few things up front:

  1. No, it's still not available. But that we've been given a pre-release version to share should tell you something.
  2. Yes, we're all very much aware that we've been talking about Carbon, off and on, for more than a year now. (A whopping six stories out of some 6,000 written over 13 months, if our math is right.) Announcements of imminent release have come and gone, followed by long periods of silence. You can either choose to get over that, read this preview and give this app a shot when it's released in the near future, or not. 
  3. There are now two Carbon apps for Android. This one, obviously, is the Twitter app, from the developer dots & lines, which first brought Carbon to webOS, where it garnered much praise. It later came to Windows Phone before being put out to pasture, much to the chagrin of this Microsoft faithful. The other Carbon app is a backup and sync client from Koushik Dutta. We're not sure which app will see first public release (our money's on the backup app), but having two apps with the same name is about as fun for us as it is for you, we reckon.
  4. Carbon (the Twitter app) may well be the best-designed Twitter app we've used yet -- and there are some good ones out there.

(AP) ? The legal challenges over religious freedom and the birth control coverage requirement in President Barack Obama's health care overhaul appear to be moving toward the U.S. Supreme Court.

Faith-affiliated charities, hospitals and universities have filed dozens of lawsuits against the mandate, which requires employers to provide insurance that covers contraception for free. However, many for-profit business owners are also suing, claiming a violation of their religious beliefs.

The religious lawsuits have largely stalled, as the Department of Health and Human Services tries to develop an accommodation for faith groups. However, no such offer will be made to individual business owners. And their lawsuits are yielding conflicting rulings in appeals courts around the country.

"The circuits have split. You're getting different, conflicting interpretations of law, so the line of cases will have to go to the Supreme Court, " said Carl Esbeck, a professor at the University of Missouri Law School who specializes in religious liberty issues.

Last year, the Supreme Court ruled that Obama's fiercely contested health care overhaul, known as the Affordable Care Act, was constitutional. But differences over the birth control provision in the law have yet to be resolved.

Under the requirement, most employers, including faith-affiliated hospitals and nonprofits, have to provide health insurance that includes artificial contraception, including sterilization, as a free preventive service. The goal, in part, is to help women space pregnancies as a way to promote health.

Religious groups who employ and serve people of their own faith ? such as churches ? are exempt. But other religiously affiliated groups, such as Catholic Charities, must comply.

Roman Catholic bishops, evangelicals and some religious leaders who have generally been supportive of Obama's policies have lobbied fiercely for a broader exemption. The Catholic Church prohibits the use of artificial contraception. Evangelicals generally permit the use of birth control, but they object to specific methods such as the morning-after contraceptive pill, which they argue is tantamount to abortion.

Obama promised to change the birth control requirement so insurance companies and not faith-affiliated employers would pay for the coverage, but religious leaders said more changes were needed to make the plan work.

The Health and Human Services Department said it could not comment on litigation. A spokeswoman also did not respond to a question about when the latest revisions in the birth control rule would be made public.

However, government attorneys responding to a lawsuit said an announcement was expected by the end of March. In the suit filed by the evangelical Wheaton College in Illinois and Catholic Belmont Abbey in North Carolina, the court ordered government attorneys to provide a progress report on the new rule every 60 days. Whatever its final form, the mandate will take effect for religious groups in August.

At the center of the cases is the Religious Freedom Restoration Act, the 1993 law that bars the government from imposing a substantial burden on the exercise of religion for anything other than a compelling government interest pursued in the least restrictive way. The question of how or whether these criteria apply when owners of for-profit businesses have a religious objection to a government policy hasn't been fully tested.

"It's more natural for people to say Notre Dame exercises religion, but when you say this power tool company exercises religion, you have to explain it little more, I think the claims are really the same," said Kyle Duncan, general counsel for the Becket Fund for Religious Liberty, which represents many of the plaintiffs.

Brigitte Amiri, senior staff attorney at the American Civil Liberties Union, argued the business owners are trying to use a religious liberty claim to deny benefits to someone else.

"We don't think that religious liberty claims can be used as a way to discriminate against women employees ? using those claims to take away someone else's benefits and services," Amiri said.

In the lawsuits from faith-affiliated groups, such as the University of Notre Dame, judges around the country have generally said it would be premature to decide the legal issues until the federal rule for religiously affiliated organizations is finalized.

In the cases involving business owners, judges have granted temporary injunctions to businesses in nine of 14 cases they've heard, while questions about for-profit employers and religious rights are decided, according to a tally by the Becket Fund.

In a case brought by Cyril and Jane Korte, Catholic owners of Korte & Luitjohan Contractors in Illinois, a three-judge panel granted a temporary injunction, ruling 2-1 that providing employees insurance coverage that includes birth control would violate the Kortes' faith.

"It is a family-run business, and they manage the company in accordance with their religious beliefs," the judges wrote.

The dissenting judge argued that the company will not be paying directly for contraception but instead will purchase insurance that covers a wide range of health care that could include birth control, if the woman decides with her physician that she needs it.

"What the Kortes wish to do is to preemptively declare that their company need not pay for insurance which covers particular types of medical care to which they object," the dissenting judge wrote.

Similar reasoning was used by courts denying an injunction requested by the arts and crafts chain Hobby Lobby and religious book-seller Mardel Inc., which are owned by the same evangelical family. Oklahoma-based Hobby Lobby calls itself a "biblically founded business" and is closed on Sundays.

The U.S. district judge who first considered the request said, "Hobby Lobby and Mardel are not religious organizations."

"Plaintiffs have not cited, and the court has not found, any case concluding that secular, for-profit corporations such as Hobby Lobby and Mardel have a constitutional right to the free exercise of religion," the ruling said.

'Dallas' returns with J.R. Ewing's final schemes

(AP) ? J.R. Ewing wouldn't hesitate to cheat his fellow man. He also famously cheated death.

In the second-season finale of "Dallas" back in 1980, he was shot by an unknown assailant in his office and left for dead. But he recovered nicely, and the cliffhanger question that gripped the nation (Who shot J.R.?) was answered that November in an episode seen by 80 million viewers.

This time, J.R. won't get off so easy. During the second season of TNT's rebooted "Dallas," J.R. cashes in his chips and goes to his reward ... wherever that may be.

Meanwhile, viewers, however braced they are for J.R.'s demise, will have to reckon with the loss of arguably TV's greatest villain, and bid farewell to the actor who portrayed him so indelibly and also cheated death for years. This double loss would be a burden for any show to bear. "Dallas," returning at 9 p.m. EST Monday, comes fully loaded.

"I think viewers want closure," said Linda Gray, who plays J.R.'s long-suffering ex-wife, Sue Ellen. "They want to mourn Larry Hagman and J.R. Ewing. They want to know they can grieve the fact he won't be around."

But all that comes later. With its two-hour season premiere, "Dallas" carries on in familiar fashion, with the expected two-timing, squabbles, a kidnapping revealed, a stolen identity and assorted other mischief.

And never fear: J.R., though visibly frail, continues his reign as a scheming oilman and rascally Ewing patriarch.

"I came over to deliver some muffins to the pretty little secretaries," he announces on making an unannounced visit to Ewing Energies headquarters before he laments, "Who could have guessed so many would turn out to be MEN? Where's the sport in THAT?"

In another scene, J.R. shares sly counsel with his son, John Ross, on double-crossing other members of the family: "Love, hate, jealousy: Mix 'em up and they make a mean martini. And when we take over Ewing Energies, you'll slake your thirst ? with a twist!"

The new "Dallas," which debuted last June, is stocked with a troupe of young regulars (including Josh Henderson, who plays John Ross), as well as veterans of the original CBS series, notably Gray and Patrick Duffy as J.R.'s ever-upright brother, Bobby. J.R. will appear in a minimum of five or as many as seven of the season's episodes before he meets his fate.

After that, can "Dallas" survive the dual deaths of its central character and legendary star?

"Larry being gone doesn't eliminate the influence of the character of J.R.," Duffy pointed out. Who knows what land mines J.R. will have left behind? "We can find business deals he did or schemes he started that now are coming home to roost, and they can turn up for years to come."

"Whatever will happen on the show, we will be talking about J.R. Ewing and he will have done things that have a ripple effect," Gray agreed. "He will always be there."

"There's a lot of driving forces on the show ? not just J.R.," added "Dallas" executive producer Cynthia Cidre, who, interviewed by phone a couple of weeks ago, was parked outside a posh Dallas social club where the wake for J.R. was about to be filmed.

She said this season she tried to use Hagman sparingly.

"He was the most delightful man and a total professional," she said, "but he wasn't well and we didn't want to overtax him."

Now, with his passing, "we want to give J.R., and Larry, the proper send-off."

But she insisted there had been no contingency plan for how to plot J.R.'s demise in the event Hagman died in mid-season.

"We didn't have a Plan B, on purpose," said Cidre. "We just knew that we had Larry, so let's use him, let's enjoy him, and if something happens, we'll scramble and fix it. I had great faith in the writers' room. We knew the day might come and what we would do then: Figure it out."

That day came in late November when she got a call from Duffy. "He told me, 'Larry's in the hospital and it isn't good. He's saying goodbye.' In 24 hours we had fixed one of the scripts. We had two more scripts that had to be adjusted, and then this episode we're shooting now, the Goodbye Episode."

Roughly 85 percent of the season's story line remains intact, she said, supplemented by the death of J.R. and the mystery surrounding it: Who Killed J.R.?

"The mystery has all the machinations of a great J.R. business deal, as opposed to a whodunit," said Duffy. "Cynthia constructed a really interesting plot, of which I know Bobby's portion" ? including whodunit ? "but I don't know other stuff."

"We all know, up to a point," Gray said. "But they've got secret pages that we've not seen."

"I hope that we have come up with something really wonderful and enticing," said Cidre, "and by the time you're done watching episode 208, which I call the Funeral Episode, I hope you're saying, 'Omigod, I didn't see that coming, and I can't wait to watch the rest of the season.'"

The mystery, she said, will continue through episode 15, "with a giant, delightful, delicious climax in the season finale."

To get there, shooting continues until April on the Dallas set, where, even two months after Hagman's passing, "I'm lonely because my best friend isn't there to play with," Duffy said. "I was with him from 1978 until his final hours in the hospital. But I have no regrets. Every day I think of him and smile."

"I keep expecting him to walk in the door," Gray said. "He's so missed. But his presence is everywhere!"
